Analysis of the 8th Amendment 8th Amendment Introduction The 8th Amendment (Amendment VIII) to the United States Constitution can be legally defined as the section of the United Sates Bill of Rights that which forbids the federal government from imposing excessive fines, neither inflicting cruel and unusual punishments nor imposing excessive bail. The 8th amendment was approved to be part of the United States Constitution in the year 1791.This amendment was almost similar to a stipulation made in the English Bill of Rights of 1689 where the government made a declaration to the point that they had to operate as their ancestors had by not demanding for excessive bail neither imposing excessive fines nor inflicting cruel or unusual punishments. In the case of England the provision was mainly driven by the punishment involving Titus Oates. During the reign of King James II in the 1680s Titus Oates worked as a fixture in the London pillory circuit. Oates was involved many ordinary penalties that had been collectively imposed forced on him in a manner that was both excessive and unparalleled. Oates had lied under oath which led to many innocent people being placed under the death sentence. Parliament approved the declaration against ââ¬Å"cruel and unusual punishments ââ¬Å"for England in the year 1689. The declaration was explained by the parliament that it was supposed to prevent punishments such as the one inflicted on Titus Oates by the Kings Bench. In December 1689 the then parliament endorsed the provision to be passed into law. The first state to adopt a stand similar to that of England on the issues was the state of Virginia. In the year 1776 the Virginia declaration of rights incorporated the English bill of rights and then went on a step further to recommend in the year 1788 that the above provision be included in the united states constitution as at the Virginia convention that meant to approve the U.S constitution. It was some Virginia states men such as Patrick Henry and George Mason that first endorsed that congress be limited by use of the restriction as in the English bill of rights. This was based on the fears that if that did not happen the congress could inflict some punishments that were both unusual and severe on criminals. The two Virginians also stressed the need for the Congress to do away with the line in the English bill of rights that seemed to admit of tortures and barbarous punishment inflicted on its people in the past. And also recommended congress to start the enactment of civil law in favor of the more practiced common law. In the end Mason and Henry were successful in their quest and then the 8th amendment was adopted by the United States. In the year 1789 James Madison changed the words ought in the English bill of rights toâ⬠shall then proposed it to the congress for amendment. Cruel and unusual punishments The eighth amendment according to the Supreme Court prohibited entirely the infliction of some punishments and at the same time forbid some other punishments which when compared to the crime for which they were given for were seen to be excessive or those which were seen to be excessive when the competence of the perpetrator was put into light. This was seen as necessary because in the earlier years some of the judgments handed down to the people were in excess considering the fact that the perpetrators were either incompetent to commit such crimes or the crimes committed were minor. In the year 1962 the supreme courts ruled that the cruel and unusual punishments act applied to all the states of the United States through the fourteenth amendment. This followed the case involving Robinson vs. California, 370 U.S. 660 in the year 1960. Before the Robinson case the eighth amendment had only earlier been applied in cases against the federal government. In the case involving Furman vs. Ge orgia, 408 U.S. 238 of the year 1962 the four principles that would determine whether a punishment passed onto a perpetrator was ââ¬Å"cruel and unusualâ⬠were written by Justice Brennan. These included statements that for the punishment handed down judging by how severe it is degrade human dignity under conditions as in the case of torture, it also that any unusual and cruel punishment was one which was totally and clearly rejected by the whole society, one which was seen to be inflicted in a manner that was seen to be wholly arbitrary or one that was patently unnecessary. Brennan went on to write that it was an expectation that no American state would pass a law that would seem to undermine any of the four principals, such that all decisions made in court involving the eighth amendment would consider all the these principles. The punishments for which according to the eighth amend were forbidden regardless of the crime committed would include any form of disemboweling, public dissecting, drawing and quartering or burning alive. This in relation to the four Brennan principles where punishments that were totally rejected throughout the society. In the cases of Atkins vs. Virginia 536 U.S. 304 of 2002 the supreme court declared executing mentally handicapped people fell in the forbidden punishments and also in the case of Roper vs. Simmons 543 U.S. 551 of 2005 where the court ruled that executing people under18 years was a violation of the eighth amendment regardless of the crime committed by the perpetrator. Punishments that were forbidden for certain crimes included cases in which the court had to overturn punishments such as the cadena temporal which mandated that ââ¬Å"hard and painful laborâ⬠shackling are done away with while in the process of incarceration or when faced with civil disabilities that were permanent. The case mentioned above took place in 1910 and was often seen as a means of establishing some proportionality when applying the eighth amendment. In some other cases it was ruled that punishing a natural-born American citizen for any crime by taking away his citizenship was perceived to be unconstitutional and primitive as it involved completely damaging the persons status in the society. In a case involving Coker vs. Virginia 433 U.S. 584 of 1977 the court at the time clearly stated that the imposition of a death penalty or rape was totally unconstitutional and that applied to any other case where death did not occur. It went ahead to clarify that rape crimes by d efinition do not include either death or even any serious body harm to the other person. Excessive fines For many years the United States Supreme Court never had much to say when the subject of excessive fines was mentioned. In one early case the Supreme Court had no power to revise any judgments passed by a lower court as regards the subject of heavy fines being imposed on someone. In later years the need to need to review the amount of fines levied on a person because it always led to the imprisonment just because the person was unable to raise the amount imposed on him/her by the court. In a step meant to ensure equal citizen protection the court found a way to put to meaning the words ââ¬Å"excessive finesâ⬠when compared to the person for whom the judgment is meant to affect. But the court also ruled out applying the above clause could not be applied to cases involving private cases where the government had not been involved in the prosecution nor was it to receive any share of any of the awarded damages. This decision was based on the intention for which the excessive fines clause was meant for. The court clearly stated that at the time when the eighth amendment was adopted into the united states constitution the word ââ¬Ëfine was taken to refer to any payment that would have to be made to sovereign entity for an offence committed. THE court left open the decision as to whether the clause could be applied to qui tam actions or cases involving civil penalties but at the same time it concluded that the excessive fines clause was initially intended to affect the fines that were only imposed by one payable to the government. In cases involving any civil forfeiture the excessive fines clause could be applied. The meaning of the clause as it regards to the quantum punishment of any particular offences when it is independent of the ability of the offender to pay the fine imposed on him still awaits the result of legal proceedings. Excessive bail In England it was the duty of the sheriffs to decide whether or not a person deserved to be granted bail. Due to the continual abuse of power by the sheriffs the government back then released a statute that clearly categorized the bailable and the non-bailable offences. But these statutes could be subverted according to the decision of the Kings judges. According to the law then a person could be held without bail depending on the commands of the sovereign authority. It was often argued that the King did not have the authority to make such decisions and this led to the infringement of human rights when people were intentionally kept in prison despite having committed bailable offences. This and many more ambiguities were eventually put to an end by the Habeas Corpus Act of 1679. After the Habeas Act was passed judges were faced with the decision to set the bail amounts but they often posed some amounts that were impracticable. It was until the year 1689 that the English bill of right s forbids the demand of excessive rights but a further amendment to distinguish between bailable and non bailable offences was needed. Bail is said to be excessive and in violation of the Eighth amendment if the value to which it is set is higher when compared to the reasonably calculated value that is aimed at ensuring the governments asserted interest. The aim of setting bail is said to be as a guarantee that the person who is accused is going to present himself for trial and accept the sentence that is handed down to him and no more. In order for a person to be able to challenge the amount of bail imposed on him he must move for a reduction. If the reduction is denied then the court of appeals followed by the Supreme Court can overrule the decision. The eight amendment could not be applied to post convicted release cases that await appeal but it is normal practice to grant leases in such cases. Bail is seen to uphold the presumption of innocence before a person is tried acquired only after centuries of struggle. The excessive bail clause adopted by the United States constitution from the English bill of rights had slight changes made on it. In the England act there was no provision that stated that one had the right to bail at all times but only provided that the bail amount imposed on a person was not to be excessive in the cases that bail could be granted. The governments argued that the amount of bail imposed was not to be excess when compared to the weight of the crime committed by the person. Conclusion The eighth amendment to the United States Constitution was a good step in defining various issues that surrounded judgments passed onto persons since time in memorial. It is aimed at eliminating the infringement of the basic human rights as it regulated the amount of punishment that one could be given based on the offence. In the years before the amendment could be done peoples rights were sometimes stepped on as some of the judgments passed amounted to torture on the person. This is in a way seems to bring fairness in the judicial System of the United States. This amendment protected people from situations where the amount of bails, fines imposed on the person could not match the perception of the crime committed. The American constitution is supposed to ensure a stable and responsible government. It is generally supposed to protect the rights of the American citizens even against infringement by the government itself. this is exactly what the eighth amendment went on to do, making every citizen equal before the law and making sure every citizen gets a fair judgment based on the crime committed, whether it regards the bail set or the amount of fine one is asked to produce. Effect of Light in The Stranger and One Day in the Life of Ivan Denisov
The light in the two novels The Stranger and One Day in the Life of Ivan Denisovich(One Day) has an animalistic effect on the protagonists. In The Stranger, Meursault complains about the intensity of sunlight. His nature is not a light friendly one, he becomes distracted and begins to sweat under intensive light. Meursault may in several ways be compared to a bat, confused and irritated by light, though when in a dark environment, he is able to concentrate and focus. On the other hand, Shukov from One Day experiences light as mental freedom from the dark camp. Light allows him to hope for a better future for him and everyone in the camp. Shukov shows animalistic features as well, as he wakes with the sun rising and ends his day with the sunset. He tolerates darkness as long as he does not encounter major vision difficulties due to the dark. Meursault lives in a small town at the beach with daily, sunny and warm weather. On the contrary is the weather in the USSR, in which Shukov has family and a home . The USSR, by maintaining mostly negative temperatures throughout the year, transmits a rather negative image of the environment. Both protagonists ironically react to light and darkness opposite to the presence of light and darkness in their environment. In The Stranger, Meursault is not able to tolerate intensive light which causes him to think narrowly and furthermore behave according to such thoughts. He does not seem to feel any emotions at his motherââ¬â¢s funeral as he shows more interest in the details of her death than his emotional connection to her as his mother. He is more bothered by the intensity of the light than the fact that his mother died. He portrays this kind of attitude at his motherââ¬â¢s funeral and then later on ... ...eursault is lead by it and thus is not fully aware of his actions. Another difference between both characters exists on their emotional level. One has to allow light to enter the heart to have the ability of sensing feelings. Being suppressed by the authority, Shukov sees light as hope for freedom and is well-heartedly open to it. Mersault though is not able to tolerate it thus open his already emotionless heart for it. He does not know if he loves Marie, nor cares who he would be married to. No tears are spilled by him at his mother's funeral and he neither shows any kind of emotions at his own execution. Meursault is not able to say if his lawyer is on his side and if he can trust him because there "no way of knowing it, because our heart is blind." (The Stranger, 120) Light entering the eye allows us to have vision, only light entering the heart allows emotions.

African American Politicians
During the reconstruction era over two thousand African Americans served in federal, state, and local offices. Information on these individuals is difficult to find, seeing as during this time black lawmakers were condemned as subhuman, and in no need of documentation. Eric Foner, author of Black Politicians in the Reconstruction Era, stated that of the two thousand he only found about 1465 for his book. A great deal of the information on these men and the offices they held was obscure and incorrect. Many scholars had false information about the education level of these African American lawmakers. For example, many scholars claimed that most black delegates to the Georgia convention were illiterate, actually twenty-two of these thirty-seven could read and write. This was impressive seeing as it was against the law in many states for African Americans to be taught how to read or write. The basic research on these politicians was not done because these scholars thought they knew all they needed to know. These lawmakers were black; many were ex-slaves, so they must have been ignorant, corrupt, and incompetent, this was the stereotype, but it was not so! Many of the African American leaders saw fit to educate themselves. Men like John Roy Lynch, who took time off from his photographerâ⬠s studio to observe a white classroom from across an alley. He continued this until he had mastered all of the classes taught there. Situations like this show the desire and determination these men had to learn. He used this training to become speaker of the Mississippi house and later a member of congress. These are only two of the many examples of African Americans who self educated themselves in a time when African Americans were banned from education. Others did have a formal education. In South Carolina, State Treasurer Francis L. Cardozo attended Glasgow and London. He was a minister in New Haven and a principal for the School for Blacks in Charleston. These were better credentials than some white politicians had. Economically black politicians were in no way reaping the monetary rewards that Conservatives and white carpetbaggers enjoyed. While African Americans status impressive compared to other freedmen, most could not translate political power into a share of the economic growth of their states. Even prominent leaders such as Hiram Revels, who was the first the first black man to serve in the United States Senate sometimes found it necessary to take small loans from white politicians to meet every day expense. The reconstruction era was a difficult time for African American politicians. In a time when negative stereotypes where all too common, and the color of your skin determined your level of intelligence in the eyes of many. Black leaders had to work twice as hard to accomplish half as much. An extremely relevant point, and a credit to the African American politicians was the fact that there was a very small amount of vindictiveness in their actions and words. They had no dreams or desires to take advantage, or become greedy with the power they were beginning to acquire. They seemed more fixated on receiving what they thought they were entitled to. Beverly Nash, a member of the South Carolina convention, asserted in his first speech, ââ¬Å"the white man is a true friend of the black man. He went on to say, ââ¬Å"I you could see the scroll of the society that banner represents, you would see the white man and the black man standing with their arms locked together, as the type of friendship we desire. â⬠Even when some leaders such as Henry McNeal Turner, who was almost universally disliked by whites, still did what he could to assist in helping the white economy recover its economic strength. Even after all that was done to them, the black leaders held no resentment, and worked for the benefites of blacks and whites as a whole. In conclusion, there are many misconceptions about African American leaders during the era of reconstruction. From their level of education, to the positions they held, and the lifestyles they lead. Black leaders were equally, if not more qualified than their white counter parts for political positions. Unfortunately they were not being compensated in the same manner as the white politicians.

Organizations are groups of people frequently trying to organize some specific subject, such as political issues. So, even while organizing can be viewed as a simple definition, it can get as complex as organizing the worlds information. Organising also means creating an organisation structure that is suitable for th e achievement of the agreed objectives. Work has to be allocated, lines of authority and responsibility defined, and a system of rules and procedures that guide the conduct of employees laid down. The structure should not be regarded as permanent but as constantly changing to suit the organisations needs. The organisation is where resources come together. Organisations use different resources to accomplish goals. The major resources used by organisation are often described as follow : Human resources financial resources, physical resources, and information resources. Managers are responsible for acquiring and managing the resources to accomplish goals. Organising will work towards maximum efficiency and minimum waste. Organising helps organisation to reap the benefit of specialization. Organising provides for optimum utilization of resources. Organising helps in Effective administration. Organising channels for expansion and growth. Organising achieves co-ordination among different departments. Organising creates scope for new change. The advantages of this include easy communication due to shared specialization, better performance evaluation within the team, and quicker decision making as they are all on the same perspective. The main disadvantage is that coordination between different departments become more difficult. Divisional, which is based on product, market or geography has the advantage of functions being able to focus on a specific good, service or customer. This promotes high quality products and customer service. The risk is in conflict arising between division if they begin to compete for organisational resources or pursue individual objectives. Other than that, organising plays a central role in management process. Once plans are created the managers task is to see that they are carried out. Given a clear mission, core values, objectives, and strategy, the relationship. It identifies who is to do what, who is in charge of whom, and how different people and parts of the organisation relate to and work with one another. All of this, of course, can be done in different ways. The strategic leadership challenge is to choose the best organisational form to fit the strategy and other situational demands. When organising, managers must take decision about the division of labour and work specialization, departmentalization, chain of command, span of management, centralization, and formalization. Collectively, these decisions are often called organisational design. There is no standard formula for the best way to organise an enterprise. Several factors have been shown to influence organising decision. Among the most important of these factors are strategy, size, environmental conditions, and technology. Managers organise in order to achieve the objectives for the enterprise for which they work. Thus, the strategy of the enterprise affects organising decision. Change in strategy frequently necessitates changes in the way the enterpri se is organised. Small enterprise tend exhibit less formalization, centralization, and complexity in their organisational structure. Nevertheless, enterprises of the same size may be organised quite differently because of differences in strategy, environmental conditions, and technology. The key factor in the external environment that is relevant to organising is uncertainty. Some enterprises face competitive environments that change rapidly and quite complex, while others face relatively stable conditions. Generally, turbulent environments call for organising decisions that lead to less formalization and centralization in the organisational structure. The processes by which an enterprise transforms inputs into outputs may also affect organising decisions. Some research suggests that organising decisions that lead to high degrees of formalization, centralization, and work specialization are more appropriate for routine technologies and that the converse is true for non-routine techn ologies. Competition is tough but is steady and manageable, the handling of cost leadership is reasonable and such differentiation follows an organized pattern is such focused activities and events of the company. In other words, the leader attribute pattern approach argues that integrated constellations or combinations of individual differences may explain substantial variance in both leader emergence and leader effectiveness beyond that explained by single attributes, or by additive combinations of multiple attributes. In response to the early criticisms of the trait approach, theorists began to research leading as a set of behaviors, evaluating the behavior of successful leaders, determining a behavior taxonomy and identifying broad leading styles. For example, Leading takes a strong personality with a well developed positive ego. Not so much as a pattern of motives, but a set of traits is crucial. To lead self-confidence and a high self-esteem is useful, perhaps even essential. The researchers evaluated the performance of groups of eleven-year-old boys under different types of work climate. In each, the leader exercised his influence regarding the type of group decision making, p raise, criticism and feedback , and the management of the group tasks project management according to three styles is : authoritarian, democratic and laissez-faire. Authoritarian climates were characterized by leaders who make decisions alone, demand strict compliance to his orders, and dictate each step taken; future steps were uncertain to a large degree. The leader is not necessarily hostile but is aloof from participation in work and commonly offers personal praise and criticism for the work done. Democratic climates were characterized by collective decision processes, assisted by the leader. Before accomplishing tasks, perspectives are gained from group discussion and technical advice from a leader. Members are given choices and collectively decide the division of labor. Praise and criticism in such an environment are objective, fact minded and given by a group member without necessarily having participated extensively in the actual work. Laissez faire climates gave freedom to the group for policy determination without any participation from the leader. The leader remains uninvolved in work decisions unless asked, does not participate in the division of labor, and very infrequently gives praise. Positive reinforcement occurs when a positive stimulus is presented in response to a behavior, increasing the likelihood of that behavior in the future. The following is an example of how positive reinforcement can be used in a business setting. Assume praise is a positive reinforcement for a particular employee. This employee does not show up to work on time every day. The manager of this employee decides to praise the employee for showing up on time every day the employee actually shows up to work on time. As a result, the employee comes to work on time more often because the employee likes to be praised. In this example, praise is a positive reinforcement for this employee because the employee arrives to work on time more frequently after being praised for show ing up to work on time. The use of positive reinforcement is a successful and growing technique used by leaders to motivate and attain desired behaviors from subordinates. Used reinforcement to increase productivity and also increase in performance. Additionally, many reinforcement techniques such as the use of praise are inexpensive, providing higher performance for lower costs.

Muhammad Ali Muhammad Ali, whose birth name was Cassius Marcellus Clay, was born in Louisville, Kentucky January 17, 1942. He was named for a white, Kentucky abolitionist, Cassius M. Clay, and received the name Marcellus from his fatherââ¬â¢s name. Aliââ¬â¢s father, Marcellus Clay was a mural painter who did a lot of work for many churches in the community and his mother Odessa (Grady) Clay was a domestic worker. As a young boy, Cassius Clay was full of energy and carried a loud mouth wherever he went. One day when Ali discovered that someone stole his bicycle, he became enraged and made loud threatening comments by exclaiming that he would ââ¬Å"whup whoever stole it.â⬠Upon hearing these threats, Louisville police officer Joe Martin persuaded Ali to take out his frustration in the boxing ring rather than on the dangerous streets of Louisville. At age 12, Aliââ¬â¢s boxing career had officially begun. Martin started Ali working out in Louisvilleââ¬â¢s Columbia Gym, and Ali became passionately devoted to the sport. With the help of a black trainer named Fred Stoner, who taught Ali the techniques of boxing and to move with the grace of a dancer, Ali became a very skilled and deadly competitor. Between 1955 and 1960, Ali had participated in 108 bouts, in which he won six Kentucky Golden Glove titles, two National Amateur Athletic Union (AAU) championships, two National Golden Glove crowns, and received the Gold Medal in the light heavyweight division in the 1960 Summer Olympics held in Rome, Italy. Ali was only 18 years old when he won the Olympic Gold Medal by defeating Zbigniew Pietrzykowski, a tough fighter from Poland. Shortly after winning the Gold Medal, Ali started looking for better opportunities by saying, ââ¬Å"that was my last amateur fight, Iââ¬â¢m turning pro, but I donââ¬â¢t know exactly how. I want a good contract with a good manager.â⬠Ali felt that he was on top of the world after winning in the Olympics and felt confident that people of the U.S. would be proud of his accomplishment as he brought home the ââ¬Å"Goldâ⬠. Best Man Speech - Assassination of the Groom's Character Good afternoon Ladies and Gentlemen. I am going to keep this speech fairly short because of my throat; the bride said that if I made fun of the groom too much she would cut it. Firstly, on behalf of the bridesmaids, I would like to thank the groom for those kind words and gifts. As I'm sure you will all agree, they all look absolutely beautiful and have carried out their role splendidly, so I think a round of applause for the bridesmaids is definitely in order. Just before I start the groom's character assassination, the bride was telling me earlier in the day that her pharmacy was broken into last week. The thief apparently stole ten boxes of condoms and ten boxes of viagra. The police are now looking for a hardened criminal. Next day a woman walks into the shop and asks her for some bottom deodorant, puzzled she replies, "I'm sorry we don't sell such a thing, "I beg your pardon" says the woman. ââ¬Å"I buy it from here all the time.â⬠"Do you have the empty container from the last time." enquires the bride. "Yes I doâ⬠, says the woman and she walks out to her car, then comes back in with an empty deodorant stick. "This isn't a bottom deodorant madam, itââ¬â¢s just a normal deodorant stick." The woman snatches it out of her hands and reads aloud. "To apply take off lid and push up bottom.â⬠The groom was born in 1975, a year when the Khmer Rouge invaded Cambodia and Saigon surrendered to the North Vietnamese. So itââ¬â¢s true what they say, these things always happen in threes. He went to St. Serfs school were he was a rather quiet pupil, until of course, as anyone who knows him, he stepped onto the soccer pitch. He shunned the roll of forward for the more unorthodox "bare knuckle boxerâ⬠and "chief shin kickerâ⬠role, it was novelty for him to be on the pitch a whole ninety minutes, never mind score goals. He then went on to play for Prestonfield Boys Club and then Napier University football team. Sadly this was to be the end of his sporting career, as this was when he discovered alcohol and women. After school the groom worked in a Saturday job at Homebase. I spoke to an old work colleague who was only too happy to tell me of his time there.

John Lockeââ¬ÂS Social Contract Theory Essay
This paper analyzes the social contract theory of John Locke and how his values are consistent with the criminal justice system and private security settings of today. It will further discuss whether or not Lockeââ¬â¢sââ¬â¢ values and principles apply to both criminal justice and private security venues. I will also summarize the major differences of the social contract theories; identify the key principles associated with Lockeââ¬â¢s social contract theory; identify how these principles are inculcated in the U. S. Bill of Rights; identify how these principles play out in the criminal justice system and security settings of today and finally describe freedom in relationship to personal rights and ethical standards and obligations. To begin with, Lockeââ¬â¢s theory is one in which he felt that man should have individual freedom and rights, which for all intense purposes equates to what democracy is in modern times. He believed in the concept of individual freedoms and government, also known as liberalism. He had a great respect for manââ¬â¢s moral judgment and thought that men were all ââ¬Å"pleasant chapsâ⬠. Lockeââ¬â¢sââ¬â¢ ideals were that of a capitalist mentality, and exercised perfect freedom in relation to fulfilling financial interests. He believed in an orderly society in which we should leave the state of affairs in every manââ¬â¢s hands within that orderly society. And last but certainly not least, he believed in separation of powers and in the system of checks and balances. How is liberalism in the criminal justice system today? We are very fortunate to live in a time where we can exercise our own individual thoughts. As I Iook at the criminal justice system of today, I believe that our right to have freedom of speech goes a long way in helping to make decisions based on who we should follow and what we feel is right and wrong. In order to see the major differences of the social contract theories, we must take a look at the major theories as a whole. Well to begin with, Hobbes believed in the absolute power of kings. He also believed in the ââ¬Å"state of natureâ⬠which said that all individuals were naturally equal. He thought that they should do whatever they needed to do to survive. As a result, everyone suffered from continued fear and danger of violent death; and the life of man was solidary; poor; nasty; poor; brutish, and short. He believed that the government was a leviathan that would swallow up the people. His government was headed by the king and that king was better than a group. He warned against the church meddling in the kingââ¬â¢s affairs and felt that the king was more powerful than God. He felt that the people should obey the king or choose to die. The other schools of thought came from what are called the enlightenment group which is comprised of Locke, Rousseau, and Montesquieu. They wanted to improve human conditions on earth. They generally valued natural rights as well as reason, religious tolerance, and science. Weââ¬â¢ll begin with Locke. Locke agreed with Hobbs about the state of brutality and the natural law, but disagreed with other points. First, he felt that man by nature was a social animal. He believed that the natural right of an individual could never be taken away or even voluntarily given away. In the state of nature, men mostly kept their promises and honored their obligations, and though insecure, they were mostly peaceful, good, and pleasant. According to Locke, the natural rights of individuals limited the power of the king thus he did not have absolute power as Hobbes said, but acted only to enforce and protect the natural rights of the people. Although Locke spoke out for freedom of thought, speech and religion, he believed property to be the most important natural right. Rousseau felt that man was essentially good ââ¬â ââ¬Å"a noble savageâ⬠in the state of nature. This goes back to when there were mainly animals roaming around and the condition of man was uncivilized. Once societal standards came along, he felt that man became unhappy because society was artificial and corrupt. He felt that furthering society would be the cause of more unhappiness. He believed that the advancement of the arts and sciences did not benefit mankind. On the other hand, progress of knowledge made government more powerful and crushed individual liberty. He felt that the material progress had actually undermined the possibility of sincere friendship, replacing it with jealousy, fear and suspicion. He felt that we could secure freedom regardless of the will of the majority. In some respects he agreed with Locke, but he also felt that the community should be in charge. He was an idealistic thinker who derived the ââ¬Å"We the Peopleâ⬠in the constitution. He felt that religion divided and weakened the state. Montesquieu believed that all things were made up of rules and laws that never changed. He believed that there were three types of government: monarchy, ruled by a king, a republic, ruled by an elected leader and a despotism, ruled by a dictator. Of these, he believed that a government elected by the people was the best form of government. Along this line, he believed that the success of a democracy (a government in which the people have the power) depended upon maintaining the right balance of power. He further believed that all people were not equal and he approved of slavery. He felt that women were the weaker sex and should obey their husbands but also felt that women had the ability to function in government feeling that they had a calm gentleness that were helpful qualities in the decision making processes in government. Thomas Hobbes (1651), John Locke (1689), and Jean-Jacques Rousseau (1762) are the most famous social contract thinkers. Each drew quite different conclusions about the nature of political authority. Hobbes advocated absolute monarchy, Locke advocated natural rights, and Rousseau advocated collective sovereignty in the name of the general will. The Lockean concept of the social contract was invoked in the United States Declaration of Independence, which clearly states, ââ¬Å"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain inalienable Rights, that among these are Life, Liberty and the pursuit of Happiness, ââ¬â That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the Governedâ⬠¦. ââ¬Å",. The key principles associated with Lockeââ¬â¢s theory are that in their natural state humans are drawn to doing good over evil; that they naturally know right from wrong, and that naturally humans prefer peace over chaos. His views are justly stated as (1) that all men are created equal; (2) that our rights are given divinely by our creator; (3) that government exists to secure and protect those rights, and (4) government exists by the consent of the governed, namely you and I. These principles play out with relation to the criminal justice system and private security setting of today by attempting to maintain peace and justice over chaos, and by helping society to live in its natural state. It is also within our realm to be fair and just with our response to crimes. One such specification is that we should be swift, balanced and just in our reaction to crimes and criminal behavior. Along these lines, it is essentially important that, for example, we decide on an appropriate punishment for the exercise of a capital punishment such as murder and rape. Locke set forth the view that the state exists to preserve the natural rights of its citizens. When governments fail in that task, citizens have the right and sometimes the duty to withdraw their support and even to rebel. Lockeââ¬â¢s social contract theory inculcated in The U. S. Bill of Rights by his argument that governments, by virtue of the ââ¬Ësocial contract,ââ¬â¢ are responsible for protecting the natural rights (life, liberty, and ownership of property) of citizens and he was in favor of participation of the people in government affairs, and their input is clearly embedded in the Declaration of Independence of 1776. We know that the Bill of Rights stipulated freedom of speech and prohibited cruel and unusual punishment. And finally freedom in relationship to personal rights and ethical standards and obligations has to do with our long list of personal freedoms and the ability to carry them out. We have the right to speak, to go where and when we want; we can go to work; go to church, we have the right to worship a God of our choosing; and we have the right to pursue happiness as stated in the U. S. Constitution. Condoms vs Abstinence for Public School Children Essay
Rush Limbaughââ¬â¢s article, ââ¬Å"Condoms: The New Diploma,â⬠berates the common practice of distributing condoms to school children. The iconic conservative talk show host, who is blessed with ââ¬Å"talent on loan from God,â⬠uses forceful, colloquial arguments and analogies to warn against the messages and possible dire consequences that public school condom distribution can impart on Americaââ¬â¢s children. He confidently and stridently argues that condom distribution in the schools is a dangerous, immoral policy that tends to minimize or ignore the many possible negative effects of sex. Whether a school-age child wears a condom or not, Limbaugh states that the child is potentially exposing himself and his partner to AIDS, other sexually transmitted diseases, and pregnancy. Rushââ¬â¢s arguments are sound and persuasive but some of his analogies are far-fetched and extreme, and his righteous tone and attitude may be annoying to those who disagree with him. Limbaugh passionately states his arguments using simple words, messages and analogies. His central premise, that ââ¬Å"abstinence works every time it is tried,â⬠is an irrefutable fact. That is, when a person engages in sexual abstinence she is certain to avoid the negative possible consequences of sex which include pregnancy and sexually transmitted diseases including the deadly AIDS virus. On the other hand, Limbaugh minimizes the fact that many school children are going to engage in sexual activities regardless of what they are taught and regardless of whether they have easy access to condoms. Limbaugh attacks what he sees as the absurd policy of using public tax dollars to purchase and distribute condoms in public schools. To demonstrate that absurdity, he uses some extreme analogies that are far-fetched and absurd themselves. These plain-spoken, simplistic analogies include providing ââ¬Å"safe, untainted drugs every morning in home room,â⬠and ââ¬Å"packs of low-tar cigarettes to the students for their after-sex smoke. â⬠He goes farther to the extreme as he advocates that public schools should ââ¬Å"convert study halls to Safe Sex Centers,â⬠and that these schools should also ââ¬Å"put disease-free hookersâ⬠in these centers. These suggestions are obviously facetious, but Mr. Limbaugh employs them to harshly illuminate and expose what he sees as the wrong-headed, immoral, dangerous policy of condom distribution within schools. He thinks that condom distribution serves to condone and legitimize sexual activity among minors just as providing free illicit drugs to children would legitimize that dangerous, immoral activity. Limbaugh hammers home his point simply and starkly when he asks, ââ¬Å"Would you knowingly have sex with anyone who has AIDS with only a condom to protect you from getting the disease? â⬠He believes the policy of public school condom distribution, funded by taxpayers like him, promotes and legitimizes that possibly deadly scenario for young, careless children who do not care about or comprehend the long-term consequences of their casual sexual activity. But, he fails to point out that these same careless children will be more at risk of contracting AIDS or getting pregnant if they do not use a condom during sexual intercourse. His absolute views and arguments are persuasive, but his presentation is unbalanced and he might be seen by some readers as pompous and arrogant. Whether you love him or hate him, Rush Limbaugh confidently and unapologetically conveys his conservative, moral opinions on the dangers of public school condom distribution programs. He believes that this policy is ââ¬Å"symptomatic of the larger moral decline in our societal values,â⬠and that ââ¬Å"free condom distribution in public schools can be a matter of life and death. â⬠Despite some of his extreme and ridiculous analogies, Rush persuasively and emotionally advocates that sexual abstinence is the right policy for school children and that condom distribution is simply wrong and immoral.

Challenges That May Arise When Writing a Persuasive Essay
Three challenges that might arise when writing a persuasive essay are making a plan, writing a draft, and revising your draft. While making a draft you should always consider how you can organize your ideas effectively for the readers. You can arrange your ideas and make an outline to organize your ideas effectively (Chapter 7). Doing so will allow the readers to be able to understand what point you are trying to get across without any doubt or confusion. Writing a draft can help show the readers what you mean. In your draft it should include an introduction that is catchy and that will interest your readers, have a strong and solid conclusion, and it should also have a strong solid title (Chapter 8). During the revising process of your draft you should think of ways to make your draft clearer or more convincing to the readers. This could be done by looking for ideas that donââ¬â¢t fit, looking for ideas that could use more detailed support, and connecting ideas with transitional words and sentences (Chapter 9). One more challenge that might arise when writing a persuasive essay is editing. Editing a paper will allow me to ask myself what errors could confuse my readers and weaken my point. This process can also help me find and correct errors in grammar (Chapters 22ââ¬â33), look for errors in word use (Chapters 34ââ¬â35), spelling (Chapter 36), and punctuation and capitalization (Chapters 37ââ¬â41). The strategies I will use to overcome making a draft is use my time wisely. By doing this I will be able to have a set block of time to work on this and will not be able to wait until the last minute. I will also write down any ideas that pop up in my head. So I will not forget what it was and is because it could be a useful and helpful idea to use in my paper while writing it. Another strategy I could use is to make a web of ideas while planning out my paper. To overcome the challenges of writing a draft I will need to try show what I mean to the readers, come up with a strong title, come up with a strong conclusion, and come up with a catchy way to start my introduction paragraph. While I am revising my essay I will look for ideas that do not fit and find ideas that could use more detailed support if it does not have enough detailed support already. Finally I will I will look for errors that might confuse my readers and weaken my point more closely. I could also try reading it backwards to see if it will help me find errors such as grammar, errors in word use, punctuation, and if any capitalization errors.
